Refund Policy — Apex Brain Circle™

Every guarantee is tied to a delivery date, not a mood.

Once your website, app, or loyalty rewards program is built and handed over ready for implementation, the sale is final. Before that point, you're protected by a written deadline for each deliverable — and if we miss it, you get your money back.

Effective for all engagements starting Pilot release, 2026

Two states. Two rules.

A deliverable is either sitting in your build queue with a clock running on it, or it's finished, tested, and in your hands. What refund applies depends entirely on which one is true.

After delivery

No refunds on a completed system

Once your website, app, or loyalty rewards program has been fully built, tested, and delivered ready for implementation, the engagement is considered complete and the fee is non-refundable.

This applies whether or not you have launched the system publicly, connected it to your domain, or begun using it — delivery, not launch, is what closes the engagement.

Before delivery

100% money-back guarantee, on a deadline

If we have not delivered a working, reviewable version of your website within 21 days, your app within 60 days, or your loyalty rewards program within 90 days of the build start date, you can request a full refund for that undelivered piece.

Each clock runs independently, and each guarantee applies only to the deliverable it names.

Three deliverables. Three deadlines.

Each guarantee is measured from the agreed build start date for that piece of the system, not from the date of your first payment or your first phone call.

21days

Website

If no working, reviewable website has been delivered within 21 days of build start, you're entitled to a full refund of the website portion of your investment.

100% money back

Clock starts once the mapping stage is complete and build begins.

60days

App

If no working, reviewable app has been delivered within 60 days of build start, you're entitled to a full refund of the app portion of your investment.

100% money back

Runs independently of the website and loyalty program timelines.

90days

Loyalty rewards program

If no working, reviewable loyalty rewards program has been delivered within 90 days of build start, you're entitled to a full refund of the loyalty program portion of your investment.

100% money back

Applies to the loyalty and retention build specifically, not the wider system.

What "delivered" means, exactly.

We define delivery clearly so there's no ambiguity about which rule applies. A deliverable is considered delivered, and therefore final, once all of the following are true:

  • It has been built to the specification agreed in your mapping stage
  • It has been made available for your review on a staging link, test environment, or walkthrough call
  • It is functionally ready for implementation — ordering, booking, payments, or loyalty tracking work end to end
No-refund status

A fully built, ready-to-implement system is not returnable.

Every deliverable is custom-configured to your menus, locations, services, or membership structure. Once it's built and handed over ready for implementation, it can't be resold or repurposed for another business — so, as with most custom development work, the fee becomes final at that point.

This is separate from ordinary post-launch support, bug fixes, and revisions, which continue under the terms of your build agreement.

If a deadline is missed, here's what happens.

Filing a claim under any of the three guarantees is a short, direct process.

Check the clock

Confirm the build start date for the deliverable in question, listed in your build agreement and mapping summary.

Send a written request

Email [email protected] stating which deliverable missed its window and the original build start date.

We confirm status

We verify whether a reviewable version was delivered within the window. If it was, that portion is excluded from the refund.

Refund issued

Once confirmed, the refund for the affected deliverable is issued to your original payment method within 10 business days.

The fine print.

A few conditions apply to every guarantee above.

Guarantees are per deliverable
The 21-, 60-, and 90-day guarantees apply separately to the website, app, and loyalty rewards program. A missed deadline on one does not entitle you to a refund on a deliverable that was completed on time.
Client-caused delays pause the clock
Timelines assume timely feedback, content, brand assets, account access, and approvals from your team. Delays caused by waiting on materials, sign-off, or scope changes you request pause the relevant clock for the length of the delay.
Scope changes reset the estimate
Adding new features, locations, or services mid-build after work has begun may extend the delivery window for that deliverable. Any adjustment is communicated and agreed in writing before it takes effect.
Partial delivery is assessed honestly
If a reviewable, functioning version was delivered inside the window and only minor revisions remain outstanding, the guarantee is considered met and standard revision terms apply instead of a refund.
Refunds apply to the fee paid for that deliverable
Where a system was purchased as a bundle, the refundable amount for a missed guarantee is the portion of the total fee allocated to that specific deliverable, as itemised in your build agreement.
Third-party and pass-through costs
Domain registration, hosting, payment-processor fees, and other third-party costs already incurred on your behalf are not covered by these guarantees and are handled per their own providers' terms.
Handled directly, no forms or ticket queue
